These Terms of Use form an agreement between you and Delightful Florida Recreation, LLC (“DFR,” “we,” “us”), a Florida limited liability company. By downloading or using our apps, you accept these terms. If you do not accept them, do not use the apps.
Read this first — safety. Boaters apps are reference and planning tools only. They are not a substitute for official NOAA charts, licensed marine navigation equipment, current official regulations, or the judgment of a licensed boat operator. Depths, hazards, channel positions, reef coordinates, weather, and regulations change — sometimes suddenly. You are solely responsible for the safe operation of your vessel.
1. License granted to you
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and the Apple Media Services Terms and Conditions. This is a license, not a sale. We retain all ownership of the app and its content.
2. What you may not do
- Copy, redistribute, sell, rent, sublicense, or commercially exploit the app or its datasets.
- Reverse engineer, decompile, or disassemble the app except where that right cannot lawfully be restricted.
- Extract, mirror, or republish the app’s reef, landmark, fishing-hole, river-course, point-of-interest, or regulation datasets.
- Remove or obscure any copyright, trademark, or attribution notice.
- Use the app in a way that violates any applicable law or regulation.
- Circumvent, disable, or interfere with the app’s subscription or security mechanisms.
2A. SMS customer-care terms
You may opt in to DFR customer-care text messages by sending START to the support number shown on our SMS Customer Support Consent page or by otherwise initiating a support conversation with that number. Messages are limited to support replies, troubleshooting, requested follow-ups, and service-related answers. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.
Reply STOP to opt out, HELP for help, or START to opt in again after opting out. This program is not an emergency, medical, navigation-rescue, law-enforcement, or safety service. Do not send passwords, verification codes, payment data, medical records, or other secrets by text.
3. Subscription, trial, and renewal terms
No subscription is offered at first release. The app ships with no purchase, no subscription and no introductory offer. This section sets out the terms that would apply if one is introduced later, so that the rules are published before there is any money involved rather than after. Until then nothing in it takes effect.
No price appears anywhere on this site. If a subscription is introduced, the App Store listing will be the only authoritative source for what it costs.
Full access is sold as an auto-renewable subscription processed by Apple through your Apple Account.

Regions, and what we do and do not promise
Each app covers one state, and water is added to it as regions over time. Your subscription entitles you to every region in that state app, including regions added after you subscribe, at no additional charge for as long as the subscription is active. We will not separate an existing region into a paid add-on or place previously included water behind a further purchase.
What we do not promise is timing. We publish a build order, and it is a statement of intent rather than a commitment. Any region, target or sequence shown on our website or elsewhere may change, and no date is guaranteed. If a subscription is offered in future, judge it on the water covered at that time, not on water we have said we intend to add.
If subscriptions are offered, a subscription to one state edition would not grant access to another. Each state would be sold separately.
Unused trial time. If you buy a subscription during a free trial period, any unused portion of that trial is forfeited.
Price changes. We may change the subscription price. If we do, you will be told at least 7 days and no more than 30 days before the change takes effect, and the notice will state the new price and how to cancel. Apple will also notify you and, where required, ask for your consent before the new price is charged; you may cancel instead of accepting, and no new price is charged to you without the notice above.
Reminders. We send an annual reminder for every plan, including monthly ones. It names the subscription, the amount and frequency of the charge, and how to cancel. For any plan with a term of a year or longer, you also receive a renewal notice between 15 and 45 days before it renews. These reminders reach you the same way you signed up, and you do not have to opt in to them.
4. How to cancel
You cancel through Apple, not through us — we cannot cancel a subscription on your behalf:
- On your device, open Settings.
- Tap your name at the top, then Subscriptions.
- Select the Florida Boater subscription, then Cancel Subscription.
Cancel at least 24 hours before the current period ends to avoid the next charge. After cancelling you keep access until the end of the period you already paid for. Apple’s instructions are at support.apple.com.
5. Refunds
All purchases are handled by Apple, and refunds are governed by Apple’s policies and applicable law. We cannot issue refunds directly. Request a refund at reportaproblem.apple.com. If something in the app is not working, please contact us first — we would rather fix it. See our Support page.
6. Navigation and safety disclaimer
The app is not a navigation system. It is not certified, approved, or intended for use as a primary means of marine navigation, and it does not meet any standard for marine navigation equipment. Do not use it as a substitute for official NOAA nautical charts, a properly installed chartplotter or GPS, a compass, depth sounder, radio, or required safety equipment.
Coordinates, depths, hazards, channel markers, shoals, reef positions, and landmark data are approximate, may be out of date, and may contain errors. Conditions on the water change with tide, wind, storms, sediment movement, and human activity. Weather and radar data are forecasts and observations from third parties, not guarantees. You are solely and entirely responsible for safe vessel operation, route selection, weather decisions, and compliance with all laws and regulations. Verify everything against official sources before you leave the dock.
7. Data accuracy and third-party sources
The app displays public data from third parties, including the U.S. National Weather Service and NOAA, OpenStreetMap contributors, and the Florida Fish and Wildlife Conservation Commission. We do not control that data and do not warrant its accuracy, completeness, timeliness, or availability. A provider may change, delay, or discontinue its service, which may make parts of the app temporarily unavailable.
Regulations change. Season dates, size and bag limits, closures, and gear rules shown in the app are a convenience reference only. Always confirm current rules with the FWC and any applicable federal rules before fishing or boating.
8. Disclaimer of warranties
The app is provided “as is” and “as available,” without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, DFR and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, use, goodwill, vessel, property, or for personal injury or death, arising out of or related to your use of or inability to use the app, however caused and on any theory of liability.
Our total aggregate liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the twelve months preceding the claim, or twenty-five U.S. dollars ($25.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify and hold harmless DFR and its members, officers, and agents from any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys’ fees, arising out of your use or misuse of the app, your violation of these terms, your violation of any law or regulation, or your operation of a vessel.
11. Intellectual property and attribution
The app, its design, code, curated datasets, and the names Delightful Florida Recreation and Delight Florida Boating are our property or are used with permission. Third-party content is attributed as follows:
- Base map data © OpenStreetMap contributors, available under the Open Database License — openstreetmap.org/copyright.
- Weather, marine forecast, alert, and radar data courtesy of the U.S. National Weather Service and NOAA. Not an official NWS or NOAA product, and not endorsed by either agency.
- Regulation reference material derived from Florida Fish and Wildlife Conservation Commission public records.
- Business and facility listings compiled from official sites and public directories. Listing does not imply endorsement or any commercial relationship.
- Apple, App Store, iPhone, and iPad are trademarks of Apple Inc. We are not affiliated with, sponsored by, or endorsed by Apple Inc.
12. Privacy
Our handling of information is described in our Privacy Policy, which forms part of these terms. In summary: no accounts, no tracking, no advertising, no analytics, no sale of personal data, and location used on your device for navigation readouts.
13. Apple as a third-party beneficiary
This agreement is between you and DFR only, not Apple. Apple has no obligation to furnish maintenance or support for the app. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims. In the event of any third-party claim that the app infringes intellectual property rights, DFR is solely responsible for the investigation, defense, settlement, and discharge of that claim. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Term and termination
These terms apply for as long as you use the app. You may terminate at any time by cancelling your subscription and deleting the app. We may suspend or terminate your license if you materially breach these terms. Sections 6 through 11 and 15 survive termination.
15. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, except that the Apple Media Services Terms and Conditions govern matters relating to your App Store purchase. Nothing here limits any mandatory consumer protection right you have under the law of your country of residence.
16. Changes to these terms
We may update these terms. The revised version will be posted on this page with a new effective date and reflected in the in-app legal text. Continuing to use the app after a change means you accept the revised terms. If you do not accept them, cancel your subscription and stop using the app.
